I reckon that would be a stretch to argue legally. Customary law would almost certainly regard the guy as a head of state, even if actual international law didn’t. Not sure how the UK courts work though.

That being said, I like seeing the big P hurting over this shit.

What’s interesting that these guys are essentially asserting that the Vatican is not really a sovereign state, and the Lateran Treaty is bull-crapiolio. If this court case goes anywhere it will first have to discern if the Vatican is, in fact, a sovereign nation. And if it isn’t, does that mean I can’t include it in my country-counting exercise? :D

Considering that the “Independent Republic of Sealand” can legally argue that it is a recognised state because the Germans once sent a diplomat there to negotiate for a hostage, then I think arguing that the Vatican (which has been formally recognised by Italy, albeit Mussolini) is not a state is going to be a stretch.
